About a month ago, the Wall Street Journal reported that the Trump administration was considering a $100,000 fee for OPT. Now, the proposal has officially been sent to the White House for review.

DHS has advanced a new proposed rule called “Fee for Certain H-1B Petitions.” White House review was completed on August 19, 2026. The rule could create a new fee for certain H-1B petitions and increase costs for employers.

USCIS’s I-140 data shows a clear trend: both EB-1A and NIW have become significantly harder over the past year. USCIS scrutiny is getting tougher.

USCIS will use new 09/15/26 editions of Forms I-539 and I-765, with no grace period.
